Terms of Service
1. Who we are
The Infinite Archive, at theinfinitearchive.com (the “Service”), is operated by Epic Sky, LLC, a Delaware limited liability company. In these Terms, “The Infinite Archive,” “we” and “us” refer to the operator. You can reach us at hello@theinfinitearchive.com. By creating an account, buying a membership or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT, A CLASS-ACTION WAIVER AND A JURY-TRIAL WAIVER. THESE PROVISIONS LIMIT HOW YOU MAY BRING OR RESOLVE A DISPUTE. PLEASE READ SECTION 14 CAREFULLY, INCLUDING THE 30-DAY OPT-OUT RIGHT.
2. Eligibility and accounts
You must be at least 13 years old to create an account or use member-only features. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you are 13–17, you may use the Service only after a parent or legal guardian has reviewed and affirmatively agreed to these Terms on your behalf and consented to any purchase or recurring charge. We may require parent or guardian contact information or other reasonable confirmation. The parent or guardian is responsible for purchases and activity under the account. If we learn that an account belongs to a child under 13, we will take steps required by applicable law, which may include deleting the account and associated information. You agree to give an accurate email address, keep your password confidential, and tell us promptly at hello@theinfinitearchive.com if you believe your account has been used without permission. You are responsible for activity under your account. One person per account; accounts may not be shared or resold.
3. Free and paid access
Some of the Service is free: the open-case dossiers, a set of dossiers we make free each month, the first expedition, the discovery universe, the timeline and the map. Full access to every dossier and expedition requires an Explorer membership. We may change which content is free, and we may add, update, correct or retire content, at any time.
4. Explorer membership, billing and automatic renewal
- Price and term. Explorer is offered at $10 (USD) per month or $120 (USD) per year, plus any applicable tax. The price and billing period are shown before you confirm your purchase.
- Automatic renewal. Before you start a membership, we will clearly disclose that it renews automatically, the amount or method for determining the renewal charge, the billing frequency, how to cancel, and any free or promotional trial conversion. You must affirmatively consent to recurring charges; merely using the Service or failing to cancel is not consent. Your membership renews automatically at the end of each monthly or yearly period, and the payment method on file will be charged the then-current price for the same period, until you cancel. By starting a membership, you authorize these recurring charges. We will send a confirmation of the purchase and recurring terms to the email address you provide.
- How to cancel. You may cancel online at any time without contacting customer service by signing in, going to Account, choosing “Manage billing & cancel”, and completing the cancellation in the secure billing portal. The cancellation path will be available through your account and will be simple and easy to use. You can also email hello@theinfinitearchive.com and we will cancel for you. Cancellation takes effect at the end of the current paid period, and no further charges will be made. You keep full access until that date.
- No refunds for partial periods. Payments are non-refundable and we do not provide refunds or credits for partially used periods, unused time, or content you did not access, except where required by law. Deleting your account ends any membership immediately, without a refund for the current period, and forfeits any remaining paid time. If you want to keep access through the end of your current paid period, cancel the membership before deleting your account.
- Price changes. If we change the price or another material term of a recurring membership, we will notify you by email at least 30 days before the change applies, and, for a member, the change will apply no earlier than the next renewal unless you affirmatively agree sooner or applicable law requires otherwise. The notice will explain how to cancel before the change applies.
- Renewal and conversion notices. We will send any reminder, renewal, conversion, or other notice required by applicable law, including, where required, before renewal of yearly memberships, before a free or promotional trial converts to a paid membership, and before a material change in recurring charges or other material terms. These notices will explain the charge and how to cancel.
- Failed payments. If a renewal payment fails, we may retry it and may suspend members-only access until payment succeeds.
- Payment processing. Payments are processed by Stripe, Inc. We never receive or store your full card number. Stripe’s terms and privacy policy apply to payment data.
5. What the archive is, and what it is not
The Infinite Archive presents research on history, science and unexplained subjects. Each claim is labeled by the strength of its evidence (Established, Contested, Unresolved, Legend or Speculative) and linked to the sources we relied on. Dossiers marked “research draft” have not yet been reviewed by a human editor. We work to be accurate, but the content is for general information and education. It is not professional, scientific, legal, medical, financial or safety advice, and it may contain errors. Reader poll results reflect reader opinion, not evidence. Images marked “fantasy illustration” are original artwork and do not depict real places or events.
6. Acceptable use
You agree not to: copy, scrape, crawl, harvest, bulk-download, republish, resell or redistribute members-only content; use any content from the Service to train, fine-tune, validate or otherwise develop an artificial-intelligence or machine-learning model without our prior written permission; share your account or circumvent the paywall or access controls; use automated tools to access the Service at a rate or in a way that burdens it; submit unlawful, harassing, infringing or spam content through polls or the question form; or interfere with the security or operation of the Service. You may quote short excerpts with attribution and a link for commentary, criticism, research or education.
7. Intellectual property
The Service, including its text, evidence labels, dossier structure, expeditions, design and original artwork, is owned by The Infinite Archive or its licensors and protected by intellectual-property laws. Third-party photographs and historical images are used under the public-domain status or Creative Commons licenses listed on our Image credits page, and remain subject to those licenses. A membership gives you a personal, non-transferable, revocable license to view the content for your own non-commercial use. It does not transfer ownership of anything.
8. Your submissions
If you send a question, correction or suggestion, you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and improve the Service, including to research and answer it. Questions are reviewed by editors and are not published automatically. Please do not include personal information in submissions.
9. Copyright complaints
If you believe material on the Service infringes your copyright, send a notice to our DMCA designated agent, registered with the U.S. Copyright Office, at: Epic Sky, LLC, 5550 Glades Rd, Suite 610, Boca Raton, FL 33431; telephone 954-352-1305; email dmca@theinfinitearchive.com. You may also email hello@theinfinitearchive.com. Your notice must include: identification of the copyrighted work; identification of the allegedly infringing material and its URL; your contact details; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act for the owner; and your physical or electronic signature. We may remove or disable access to material and terminate repeat infringers. If we remove or disable access to material in response to a notice, the affected user may send a counter-notification to the designated agent containing: the user’s physical or electronic signature; identification of the removed or disabled material and its prior location; a statement under penalty of perjury that the material was removed or disabled because of mistake or misidentification; the user’s name, address, telephone number and email address; and a statement that the user consents to the jurisdiction of the federal district court for the user’s address, or, if outside the United States, Broward County, Florida, and will accept service of process from the complaining party. We may forward a valid counter-notification to the complaining party and restore the material within 10–14 business days unless the complaining party notifies us that it has filed a court action concerning the material.
10. Suspension and termination
You can stop using the Service and delete your account at any time from your account page. Before deleting your account, cancel your membership first if you want to keep access through the end of your current paid period; deleting your account ends any membership immediately, without a refund, and forfeits any remaining paid time. We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the Service or other users. If we terminate your membership without cause, we will refund the unused portion of your current paid period, except where applicable law requires otherwise.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE INFINITE ARCHIVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnity
You agree to indemnify, defend and hold harmless The Infinite Archive from and against third-party claims, demands, losses, liabilities, damages, reasonable attorneys’ fees and other costs arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Before filing a claim in arbitration or court, you must first contact us at hello@theinfinitearchive.com and provide a written description of the dispute and the relief sought. You and we agree to try in good faith to resolve the dispute informally for at least 30 days. This informal resolution period is a condition precedent to commencing arbitration or filing a lawsuit, except where applicable law does not permit the requirement.
Binding individual arbitration. Except for the claims and proceedings expressly excluded below, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms, the Service, or your use of the Service will be resolved by binding individual arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Section to the extent permitted by those Rules. The matter will be decided by a single arbitrator. Hearings will be conducted by video conference, telephone or documents only where reasonably possible; otherwise, the hearing will take place in Broward County, Florida or in the county where you reside. We will pay arbitration fees to the extent required of us by the AAA Consumer Arbitration Rules, and you will pay only fees those Rules require you to pay.
The arbitrator, and not a court, will decide questions about the arbitrability, interpretation, applicability, enforceability or formation of this arbitration agreement, including whether a dispute is subject to arbitration. However, a court will decide the enforceability of the class-action waiver and the mass-arbitration and batching provisions below. Either party may bring an individual claim in small-claims court where eligible. Either party may also seek injunctive relief in court to address alleged intellectual-property infringement, misuse of the Service, or unauthorized access to the Service. To the fullest extent permitted by law, you and we each waive the right to a jury trial for any claim or proceeding that is heard in court, and claims may be brought only individually, not as a class, collective, representative or private-attorney-general action. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court and not in class, collective or representative arbitration. To the fullest extent permitted by law, any claim must be brought within one year after the claim arises; if applicable law does not permit that limitation for a particular claim, the shortest period permitted by law will apply.
Mass arbitration and batching. If 25 or more substantially similar arbitration claims are filed against us within a 180-day period by the same or coordinated counsel, AAA may group the claims into batches of no more than 25 for coordinated administration. Each claim will remain an individual claim and will be decided by a single arbitrator. The first batch will proceed as bellwether cases: the parties will select 10 cases, with five selected by each side, or AAA will select them randomly if the parties cannot agree. The remaining claims will be stayed while the bellwether cases proceed. After the bellwether cases are resolved, the parties will participate in a global mediation before the remaining claims proceed. If the mediation does not resolve the remaining claims within 60 days, those claims may proceed in additional batches under this Section and the AAA Consumer Arbitration Rules. The parties will cooperate with AAA to implement this procedure.
Opting out and future changes. You may opt out of the arbitration agreement by emailing hello@theinfinitearchive.com within 30 days after you first accept these Terms. Your email must include your name and the email address associated with your account. Opting out does not affect any other provision of these Terms. No change to this arbitration provision will apply to a claim that is pending in arbitration or court when the change takes effect. If we materially change this arbitration provision, you may reject the change by emailing hello@theinfinitearchive.com within 30 days after we provide notice of the change; if you do so, the prior version of this arbitration provision will apply to your future claims.
Any court proceeding that is not subject to arbitration, including a claim by a timely opt-out, a small-claims action where eligible, or a claim seeking injunctive relief described above, and any proceeding to confirm, enforce, vacate or challenge an arbitration award, must be brought exclusively in the state or federal courts located in Broward County, Florida, except that an individual small-claims action may be brought in any court where eligible. You and we consent to the jurisdiction of those courts. Nothing in these Terms limits rights you have under the consumer-protection laws of the place where you live that cannot be waived by contract.
15. Changes to these Terms
We may update these Terms. If a change is material, we will notify members by email or on the Service sufficiently before it takes effect, describe the material change, and obtain any affirmative acceptance required by applicable law. For members, a material change will not apply during the current paid term and will take effect no earlier than the next renewal, unless you affirmatively agree sooner or applicable law requires otherwise. If you do not agree, you can cancel before the change applies. To the extent permitted by law, continued use after notice and the effective date, or renewal after notice, constitutes acceptance of the updated Terms.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, labor disputes, war, terrorism, government action, internet or utility failures, or failures of third-party service providers. Notices to us must be sent to The Infinite Archive at hello@theinfinitearchive.com; we may send notices to the email address associated with your account or by posting them on the Service where permitted by law. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination—including provisions concerning intellectual property, submissions, disclaimers, limitations of liability, indemnity, disputes (including arbitration, class-action and jury waivers, the claims deadline, court venue and award-enforcement provisions), and accrued payment obligations—will survive. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Contact: The Infinite Archive, hello@theinfinitearchive.com.
